Throughout these Terms, “Appreator,” “we,” “us,” and “our” refer to the provider responsible for the applicable application or service.

“App,” “Apps,” and “Services” refer to the applications, websites, functionality, subscriptions, and related services covered by these Terms.

By downloading, purchasing, installing, accessing, or using an App or Service, you agree to these Terms.

If you do not agree to these Terms, do not use the applicable App or Service.

1. Relationship With Application Marketplace Terms

These Terms supplement any terms imposed by the platform or marketplace through which you obtained an App, including:

• Apple App Store

• Google Play

• Other authorized distribution platforms

Your use of an App may also be subject to the applicable marketplace’s:

• Terms of service

• Usage rules

• Purchase terms

• Subscription terms

• Payment policies

• License agreements

Where mandatory marketplace terms or applicable law conflict with these Terms, the mandatory marketplace terms or applicable law control to the extent of the conflict.

2. License

Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to download and use the applicable App on devices you own or control, subject to applicable marketplace usage rules.

The App is licensed, not sold.

No ownership rights in the App, source code, designs, content, trademarks, technology, or other intellectual property are transferred to you.

3. Eligibility

You may use our Apps only where you are legally permitted to do so.

If you are not legally able to agree to these Terms yourself, a parent, guardian, or other legally authorized person may need to agree on your behalf where permitted by law.

Individual applications may have different:

• Age ratings

• Minimum-age requirements

• Content restrictions

• Eligibility requirements

based on their functionality and applicable law.

4. Application Features

Our portfolio may include:

5. Local Data and User Responsibility

Some Apps store information locally on your device.

This may include:

• Photos

• Videos

• Files

• Documents

• Clipboard information

• Notes

• App settings

• Game progress

• Scores

• Saved content

• Other information

You are responsible for maintaining appropriate backups of important information.

Where information is stored only on your device and is not transmitted to us, we may be unable to recover it following:

• Application deletion

• Device loss

• Device reset

• Storage corruption

• Hardware failure

• Operating-system failure

• Forgotten credentials

• Manual deletion

You should maintain independent backups of important information where appropriate.

6. Passwords, Passcodes and Device Security

Some Apps may allow you to protect information using:

• Passwords

• PIN codes

• Device passcodes

• Face ID

• Touch ID

• Fingerprint authentication

• Other security mechanisms

You are responsible for maintaining the confidentiality and security of credentials under your control.

Depending on an application’s security design, we may be unable to:

• Recover forgotten credentials

• Unlock protected content

• Decrypt locally protected information

• Restore deleted information

Any recovery or reset functionality will operate as described by the applicable App.

7. Accounts

Certain Apps may allow or require you to create an account.

You agree to:

• Provide accurate information

• Keep your credentials secure

• Notify us of suspected unauthorized access where appropriate

You are responsible for activity carried out through your account except where applicable law provides otherwise.

Where an App allows account creation, account-deletion functionality will be provided where required by applicable law or platform rules.

8. Subscriptions and In-App Purchases

Some Apps may offer:

• Auto-renewing subscriptions

• One-time purchases

• Lifetime purchases

• Feature unlocks

• In-app purchases

• Virtual items

• Game currency

• Additional functionality

The specific:

• Price

• Currency

• Billing period

• Features

• Trial duration

• Renewal terms

will be presented before purchase.

Payments are normally processed by the marketplace through which the purchase is made.

Auto-Renewing Subscriptions

Where a subscription automatically renews, it continues until canceled according to the rules of the applicable marketplace.

The marketplace may charge the payment method associated with your account unless you cancel before renewal in accordance with marketplace requirements.

You can generally manage subscriptions through:

• Apple account subscription settings

• Google Play subscription settings

• The applicable marketplace’s subscription-management system

Deleting an App does not automatically cancel an active subscription.

Free Trials and Introductory Offers

Where a free trial or introductory offer is available, the applicable:

• Trial duration

• Introductory price

• Standard renewal price

• Eligibility requirements

will be displayed before you subscribe.

Unless canceled according to the purchase terms, a trial may convert to a paid subscription.

One-Time Purchases

A one-time purchase does not automatically renew.

Lifetime Purchases

Where a product is described as a “Lifetime” purchase, it is a non-renewing entitlement to the applicable features described at the time of purchase.

A Lifetime purchase does not guarantee that:

• A particular device will remain available forever

• An operating system will continue supporting the App indefinitely

• A third-party platform or API will operate permanently

• The App can be maintained indefinitely despite technical or legal changes

Nothing in this section limits mandatory consumer rights.

Price Changes

Subscription prices may change according to marketplace policies and applicable law.

Where required, users will receive notice or be asked to accept a price change.

Restore Purchases

Where supported, eligible purchases may generally be restored using the marketplace account originally used to make the purchase.

Refunds

Refund eligibility is generally governed by:

• Apple

• Google

• The applicable marketplace

• Applicable consumer law

Nothing in these Terms removes any refund or consumer right that cannot legally be excluded.

9. Advertising

Some Apps may display advertising.

Advertising formats may include:

• Banner advertisements

• Interstitial advertisements

• Native advertisements

• Rewarded advertisements

• Video advertisements

Advertising may be contextual, personalized, or non-personalized depending on:

• The App

• Your device settings

• Your privacy choices

• Your consent

• Applicable law

10. Games and Interactive Features

Some Apps may be games or include game-like features such as:

• Levels

• Scores

• Challenges

• Achievements

• Rewards

• Leaderboards

• Virtual items

• In-game currency

• Extra lives

• Hints

• Daily rewards

• Gameplay events

Game Progress and Saved Data

Game progress, scores, achievements, settings, and unlocked content may be stored:

• Locally on your device

• Through platform services

• Through cloud synchronization

• Through an account where supported

We do not guarantee that locally stored progress can be recovered after:

• Application deletion

• Clearing application data

• Device replacement

• Device failure

• Device reset

• Account loss

• Storage corruption

Where cloud saving is supported, availability may depend on your:

• Third-party platform availability

Game Center and Similar Services

that we reasonably determine resulted from:

• Cheating

• Manipulation

• Unauthorized modification

• Automated tools

• Exploitation of bugs

• Fraud

• Other abnormal gameplay

Virtual Items and Game Currency

Some games may offer:

• Virtual currency

• Boosters

• Hints

• Extra lives

• Cosmetic items

• Digital rewards

• Other virtual content

Unless expressly stated otherwise, virtual items:

• Have no real-world monetary value

• Are not redeemable for cash

• Cannot be exchanged for money

• Cannot be transferred between users unless explicitly supported

• Represent a limited right to use digital content within the applicable game

Purchases of virtual content remain subject to the purchase and refund provisions of these Terms.

Rewarded Advertising

Some games may offer optional rewards after users complete an eligible advertising interaction.

Availability of advertisements and associated rewards is not guaranteed.

Reward availability may depend on:

• Advertising inventory

• Network connectivity

• Technical availability

• Gameplay limits

• Fraud-prevention systems

Cheating and Exploits

You may not use:

• Cheats

• Bots

• Automation

• Modified application versions

• Unauthorized third-party software

• Exploits

• Fraudulent activity

to manipulate:

• Gameplay

• Scores

• Rankings

• Rewards

• Purchases

• Virtual items

• Competitive functionality

You may not knowingly exploit a bug or technical error to obtain an unfair advantage.

Randomized Gameplay

Games may use ordinary randomized gameplay mechanics.

Unless expressly and lawfully stated otherwise for a specific App, virtual game rewards are intended for entertainment and are not redeemable for real-world cash or monetary value.

Multiplayer and User Interaction

Where an App provides:

• Multiplayer functionality

• Messaging

• Profiles

• Usernames

• User-generated content

• Other player interaction

additional rules may be provided within the App.

You may not use interactive functionality to:

• Harass another person

• Threaten another person

• Commit fraud

• Impersonate another person

• Share unlawful content

• Cheat

• Violate another person’s rights

Game Balance and Updates

We may reasonably adjust:

• Difficulty

• Scores

• Level design

• Rewards

• Virtual economies

• Challenges

• Gameplay mechanics

• Feature availability

as part of maintaining and improving the game.

Such changes may affect gameplay strategies or progress.

Nothing in this section limits mandatory consumer rights.

11. User Content

Certain Apps may allow you to:

• Create

• Store

• Import

• Edit

• Organize

• Scan

• Copy

• Upload

• Export

• Share

text, photos, videos, files, audio, documents, or other content.

You retain ownership of content that belongs to you.

You represent that you have the necessary rights and permissions to use content through the App.

You must not use our Apps to unlawfully:

• Copy copyrighted material

• Distribute another person’s private content

• Violate intellectual-property rights

• Violate privacy rights

• Store or distribute unlawful material

Where content remains only on your device, we do not acquire ownership merely because our App processes it.

If you voluntarily send content to us for customer support or another requested service, you grant us the limited rights necessary to process the content for that purpose.

12. Acceptable Use

You must use our Apps lawfully.

You may not:

• Commit fraud

• Violate intellectual-property rights

• Violate privacy rights

• Circumvent security systems

• Introduce malware

• Attack or overload infrastructure

• Abuse services

• Impersonate another person

• Manipulate purchases

• Interfere with another user’s experience

• Use the App for unlawful activities

Except where applicable law expressly permits it, you may not:

• Copy the App

• Modify the App

• Reverse engineer the App

• Decompile the App

• Disassemble the App

• Attempt to obtain source code

• Sell the App

• Rent the App

• Lease the App

• Sublicense the App

• Redistribute substantial portions of the App without authorization

13. Intellectual Property

The Apps and related:

• Software

• Interfaces

• Graphics

• Designs

• Source code

• Original content

• Logos

• Branding

• Databases

• Technology

are owned by or licensed to Appreator and are protected by applicable intellectual-property laws.

Third-party trademarks and intellectual property remain the property of their respective owners.

No license to use Appreator trademarks, logos, or branding is granted except as expressly authorized.

14. Feedback

If you voluntarily provide:

• Suggestions

• Ideas

• Feedback

• Feature requests

you permit us to use that feedback for improving, developing, and operating our products without an obligation to compensate you.

This does not transfer ownership of unrelated personal content that you may provide to customer support.

15. Third-Party Services

Apps may interact with services operated by:

• Apple

• Google

• Cloud providers

• Payment processors

• Analytics providers

• Advertising providers

• Gaming platforms

• Websites

• Other third parties

Your use of a third-party service may be subject to that provider’s own:

• Terms

• Privacy policy

• Rules

• Account requirements

We do not control independent third-party services.

We are not responsible for the availability or conduct of independent third-party services except where applicable law does not permit that responsibility to be excluded.

16. AI and Online Processing Features

Certain Apps may include functionality powered by:

• Artificial intelligence

• Machine learning

• Remote servers

• Third-party processing systems

• Online services

AI-generated or automated output may:

• Contain errors

• Be incomplete

• Be inaccurate

• Be inappropriate for a particular purpose

You should independently evaluate important information before relying on automated output.

Unless specifically represented otherwise, general-purpose AI functionality is not intended as:

• Medical advice

• Legal advice

• Financial advice

• Professional advice

17. Updates and Changes

• Compatibility updates

Updates may modify, add, or remove functionality.

Functionality may also be affected by:

• Marketplace requirements

• Security requirements

• Third-party API changes

We do not guarantee that every feature will remain available indefinitely.

18. Suspension or Discontinuation

We may suspend or discontinue an App or feature where reasonably necessary for:

• Commercial reasons

• Platform-policy requirements

Where applicable law or marketplace requirements provide rights concerning paid functionality, we will comply with those requirements.

19. Informational, Alarm, Reminder and Similar Features

• Calculations

• Other informational functionality

Unless expressly stated otherwise, these features are general-purpose consumer tools.

They are not intended to replace professional:

• Medical advice

• Legal advice

• Financial advice

• Safety systems

Do not rely on a general consumer application as the sole method for:

• Responding to an emergency

• Protecting life

• Protecting property

• Administering essential medication

• Making medical diagnoses

• Performing other safety-critical activities

unless the particular product is expressly designed and legally authorized for that purpose.

20. Notifications and Background Functionality

Application functionality such as:

• Alarms

• Notifications

• Reminders

• Synchronization

• Background tasks

may be affected by:

• Device settings

• Battery settings

• Focus modes

• Silent modes

• Operating-system restrictions

• Permissions

• Network availability

• Device configuration

• Platform changes

• Technical errors

You are responsible for configuring your device appropriately for the features you intend to use.

21. Privacy

Your use of our Apps is subject to our Privacy Policy.

The Privacy Policy explains how information may be handled, including:

• Data deletion

22. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Apps and Services are provided on an:

“AS IS”

“AS AVAILABLE”

basis.

We do not guarantee that an App will always be:

• Error-free

• Uninterrupted

• Secure

• Compatible with every device

• Available indefinitely

• Free from data loss

• Free from technical problems

We do not guarantee recovery of information that was stored only on your device and was deleted, corrupted, or lost.

Nothing in these Terms excludes warranties or consumer protections that applicable law does not permit us to exclude.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Appreator will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages resulting from the use of or inability to use an App or Service.

This may include:

• Loss of data

• Loss of profits

• Loss of opportunity

• Business interruption

• Loss of game progress

• Loss of locally stored content

These limitations do not apply where applicable law does not allow liability to be excluded or limited.

Nothing in these Terms excludes liability for:

• Fraud

• Willful misconduct

• Other liability that cannot legally be excluded

24. Termination

These Terms remain effective while you use the applicable App or Service.

You may stop using the Service by:

• Discontinuing use

• Deleting your account where applicable

• Uninstalling the App

Uninstalling an App does not automatically cancel an active subscription.

We may restrict or terminate access where reasonably necessary due to:

• Material violations of these Terms

• Fraud

• Illegal activity

• Security threats

• Abuse

• Legal requirements

Sections that by their nature should survive termination remain effective.

25. Governing Law

Except where mandatory local law provides otherwise, these Terms are governed by the laws of India without regard to conflict-of-law principles.

Subject to mandatory consumer rights concerning where proceedings may be brought, courts having jurisdiction in Ahmedabad, Gujarat, India will have jurisdiction over disputes relating to these Terms.

Nothing in these Terms removes mandatory rights available to consumers under the laws of their place of residence.

26. Special Terms for Apps Obtained Through Apple

For Apps obtained through Apple’s App Store, the following provisions also apply.

Agreement Is With Us

These Terms are between you and the applicable App provider, not Apple.

Appreator, and not Apple, is responsible for the App and its content.

Scope of License

Your license is limited to a non-transferable license to use the App on Apple-branded products that you own or control as permitted by Apple’s applicable usage rules.

Applicable Family Sharing or similar rights provided by Apple may also apply.

Maintenance and Support

Appreator is responsible for maintenance and support to the extent required by applicable law or these Terms.

Apple has no obligation to provide maintenance or support services for the App.

Warranty

Appreator is responsible for warranties that cannot legally be disclaimed.

Where Apple’s applicable terms provide a remedy if an App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the applicable purchase price.

To the maximum extent permitted by applicable law, Apple has no other warranty obligation concerning the App.

Product Claims

Appreator, not Apple, is responsible for addressing claims relating to:

• The App

• Possession of the App

• Use of the App

• Product liability

• Legal or regulatory requirements

• Consumer-protection claims

• Privacy claims

to the extent required by law.

Intellectual-Property Claims

If a third party claims that an App or your use of the App infringes intellectual-property rights, Appreator, not Apple, is responsible for investigation, defense, settlement, and resolution of the claim to the extent required by law.

Legal Compliance

You represent that you are not prohibited from using the App under applicable export-control, sanctions, or other applicable laws.

Third-Party Terms

You must comply with applicable third-party terms when using the App.

Apple as Third-Party Beneficiary

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms with respect to Apps obtained through Apple’s App Store.

Upon your acceptance of these Terms, Apple may enforce applicable Apple-related provisions against you as a third-party beneficiary.

27. Changes to These Terms

We may update these Terms to reflect changes in:

• Our Apps

• Features

• Business operations

• Technology

• Marketplace requirements

• Applicable law

We will update the “Last Updated” date when these Terms are revised.

Where applicable law requires additional notice or consent for a material change, we will provide it.

28. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain effective to the fullest extent permitted by law.

Where legally possible, an unenforceable provision will be limited or interpreted only to the extent necessary to make it enforceable.

29. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we permanently waive our right to enforce it later.

30. Entire Agreement

These Terms, together with:

• Our Privacy Policy

• App-specific terms

• Purchase disclosures

• Subscription disclosures

• In-app notices

• Mandatory marketplace terms

constitute the applicable agreement governing your use of our Apps and Services.

An application-specific notice may supplement these Terms for a particular feature or service.
